Terms of Service

Please read these Terms of Service ("Terms") carefully before using FolioTrack ("the Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

FolioTrack is a personal investment portfolio tracking and analysis tool. It displays market data, portfolio summaries, and analytical information for informational and educational purposes only.

Nothing on FolioTrack constitutes financial, investment, tax, or legal advice. The Service does not recommend the purchase or sale of any security. Always consult a qualified financial adviser before making investment decisions.

2. Eligibility

You must be at least 18 years old to use the Service. By using the Service you represent that you meet this requirement. The Service is not available to persons who have been previously suspended or removed.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at contact@folio-track.com if you suspect unauthorised access.

You agree to provide accurate information when registering and to keep it up to date. We reserve the right to suspend or terminate accounts that provide false information.

4. Subscriptions and Payments

Access to the full Service requires a paid subscription after the free trial period. All payments are processed securely by Paddle. By subscribing, you agree to Paddle's Terms of Service.

• Free trial: New accounts receive a 14-day free trial with full access.
• Billing: Subscriptions are billed in advance on a monthly or annual basis.
• Cancellation: You may cancel at any time. Access continues until the end of the current billing period. No partial refunds are issued for unused time.
• Refunds: We may offer refunds at our sole discretion for billing errors or exceptional circumstances. Contact contact@folio-track.com within 14 days of a charge.
• Price changes: We will give at least 30 days' notice before changing subscription prices.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
• Attempt to gain unauthorised access to the Service, its servers, or related systems.
• Reverse-engineer, decompile, or attempt to extract the source code of the Service.
• Scrape, crawl, or use automated means to extract data from the Service at scale.
• Impersonate any person or entity or misrepresent your affiliation.
• Transmit viruses, malware, or any other harmful code.
• Use the Service in a manner that could damage, disable, or impair it.

6. Market Data

Market data displayed in FolioTrack is sourced from third-party providers (including EODHD) and may be delayed, inaccurate, or incomplete. We make no warranty regarding the accuracy, completeness, or timeliness of any market data. You should not rely on it for trading decisions.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by the operator of FolioTrack and are protected by applicable intellectual property laws. You retain ownership of the portfolio data you enter into the Service.

8. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy or reliability of any information obtained through the Service.

9. Limitation of Liability

To the maximum extent permitted by applicable law, the operator of FolioTrack shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, resulting from:

• Your use of or inability to use the Service.
• Any investment decisions made in reliance on information displayed in the Service.
• Unauthorised access to or alteration of your data.
• Any third-party content or conduct.

In jurisdictions that do not allow the exclusion of certain warranties or limitation of liability, liability is limited to the fullest extent permitted by law.

10. Indemnification

You agree to indemnify and hold harmless the operator of FolioTrack from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service or violation of these Terms.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service ceases immediately.

You may delete your account at any time via the Profile settings page. Upon deletion, your data will be removed in accordance with our Privacy Policy.

12. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Bulgaria, without regard to its conflict of law provisions.

For EU consumers, nothing in these Terms affects your statutory rights under applicable consumer protection laws. EU consumers may also use the European Commission's Online Dispute Resolution platform.

Any disputes not resolved informally will be subject to the exclusive jurisdiction of the courts of Bulgaria.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated by updating the "Last updated" date at the top of this page and, where appropriate, by email. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
